Eighth Circuit Dismisses Challenge Over Segway Arrests

A Minnesota lawyer sued police and the prosecutor for violating Constitutional rights when he was arrested three times in incidents involving unsafe operation of his Segway.  The Eighth Circuit upheld a District Court decision that even if the Plaintiff could not be charged with DUI under Minnesota law, the officers still had probable cause to arrest him for unsafe operation of the Segway under Minn. Stat. § 169.212. 2(b).

HB&K attorneys George Hoff and Justin Templin represented City of Medina prosecutor Steven M. Tallen in the case.
